摘要
数字经济下算法的兴起催生了价格歧视,算法价格歧视的外在表现形式多样,内在运行机制主要是基于顾客细分和消费者支付意愿。算法价格歧视反垄断存在一些难题,影响着反垄断法介入的难度与深度,且算法会议的平行决策导致了默契合谋。为此,可以通过构建算法价格歧视双层分析与规范体系方式,即从"定性+定量"的反垄断分析框架及"主动+被动"的卡特尔检测方案两方面提出应对之策。
The rise of algorithms in the digital economy has given birth to price discrimination.The external manifestations of algorithmic price discrimination are diverse,and the internal operating mechanism is mainly based on customer segmentation and consumers’willingness to pay.There are some problems in algorithmic price discrimination antitrust,which affect the difficulty and depth of antitrust law intervention,and the parallel decision-making of algorithmic meeting leads to tacit collusion.Therefore,we can build a two-tier analysis and normative system of algorithmic price discrimination,that is,the“qualitative+quantitative”antitrust analysis framework and the“active+passive”Carter detection program.
