软法治理视角下的大学校院两级管理:整体图景与实践机理

A Study on the Two-level Management of University and College from the Perspective of Soft Law Governance

软法治理视角下,校院两级管理是一个通过不断积累制度经验来优化大学内部运转的过程。从软法形态、功能和效应来看,大学呈现出"惯例型软法牵引下的校院互动圈——政策型软法导向下的校院互动链——宪章型软法统合下的校院互动网"的整体图景。从软法环境、条件和实效来看,大学呈现出以校院中心人物为枢纽的差序信任、在向上依赖和协商性控制中走向模糊治理、依效能和机会构建起院院之间的优先排序等实践机理。

In the perspective of soft law governance,the two-level management of university and college is a process of optimizing the internal operation of university by accumulating institutional experience.From the perspective of the form,function and effect of soft law,the university could present the overall picture of interactive circle of university and college driven by customary soft law-Interactive chain of university and college guided by policy soft law-Interactive network of university and college combined by charter soft law.On the other hand,from the perspective of soft law environment,conditions and actual effects,the university could present such practice mechanism as taking the core person as the hub,and showing trust in different order;moving towards fuzzy governance in upward dependence and consultative control;and determining the priority of university by the efficiency and opportunity.
