摘要
To carry out the rule of law and deepen the reform of the judicial system,it is necessary to set up a community court in China,inter alia,the areas with large population and heavy caseload.The court is attached to the local people’s court,composed of professional judges,alternate judges,lay judges and public prosecutors and other personnel.The community court can cover the whole society with the rule of law required by the Party and the government.It can deal with the cases quickly,dissolve the social contradictions and carry out the people’s participation in the judicature and ensure the legitimate rights of individuals.The establishment of the community court may achieve the goal of the rational allocation of judicial resources and relieve the pressure of the caseload of the local court.The process of the community court establishment requires the cooperation of the relevant departments,needs to have empirical pilot projects at some communities,and formulates rules,and then gradually improves the rules after the experimental experience is obtained.
落实依法治国、深化司法体制改革,有必要设立社区法院作为基层人民法院的派出机构。设立社区法院有助于将依法治国贯彻到基层,将法治工作覆盖到全社会。社区法院由专业社区法官、候补法官、业余法官以及社区检察官和其他人员组成,能够快速处理各种案件,特别是事实清楚、案情简单的刑事案件,是实现诉讼分流、化解社会矛盾、实行人民参与司法和司法为民的举措,并且有利于合理配置司法资源、减轻法院办案压力,保障当事人的合法权利。设立社区法院需要各有关部门分工负责,相互配合,先期试点,稳妥推进,在取得试点经验后制定规则,逐步完善。
