摘要
目前,疫情已经成为一种常态,大数据健康码在防止疫情传播、企业正常运转和公民出行上依然发挥着重要作用。但由于健康码以数据为支撑,所涉的主体众多、环节繁杂,因此在使用过程中可能会引发赋码不精准、个人信息泄露和滥用、数据处理不及时等一系列问题。本文从健康码的运行机制为出发点,针对运行中因不同主体参与而产生的社会风险,明确提出在申报阶段应建立用户失信机制,提高赋码的准确性、遵守信息的生命周期,对信息从最初收集到末端处理的重要环节进行规范和监控,以期实现对健康码法律规制的完善。
The health QR code supported by big data plays an important role in the context of the country’s efforts to establish herd immunity by advocating“all people eligible for vaccination have access to it”.However,as the health QR code is supported by data,it involves multiple subjects and complicated links,hence may cause a series of problems such as inaccurate coding,personal information leakage and abuse,and untimely data processing during the process.Starting from the operating mechanism of the health QR code,in response to the risks caused by the participation of various entities,this article clearly proposes that the user’s dishonesty mechanism should be established in the reporting stage,ensure the accuracy of the coding,comply with the life cycle of the information,standardize and monitor each link from the initial collection of information to the end processing.
