人工智能侵权责任现状及其问题调查报告

Investigation on the Current Situation of Artificial Intelligence Tort Liability and Its Problems

随着人工智能的广泛应用,如何对其法律地位进行界定、如何认定其侵权责任类型、如何确定其责任承担主体等问题都对当前的法律体系提出了挑战。本文在明晰人工智能侵权责任现状及对其存在问题进行归纳的基础上,通过对域外经验的借鉴与分析,在现有法律体系框架内,就如何明确界定人工智能法律地位、完善人工智能侵权责任认定等提出了若干具体建议。

With the widespread application of artificial intelligence,how to define its legal status,identify the type of tort liability and determine the subject of liability have all challenged the current legal system.On the basis of clarifying the current situation of artificial intelligence infringement liability and summarizing its existing problems,through the reference and analysis of overseas experience,some suggestions are proposed in terms of clearly defining the legal status of artificial intelligence and improving the infringement liability within the framework of the existing legal system.
