The Lack and Guarantee Strategy of Guardianship Rights of Left-behind Children in Rural Areas

随着农村剩余劳动力向城市大规模转移,催生出农村留守儿童这一特殊群体。农村留守儿童群体存在法定监护缺位、委托监护不力、群体行为失范、犯罪率较高等问题。应明确监护人职责,引入监护监督制度,通过法制教育和文化服务,全面保障留守儿童监护权益的实现。

With the large-scale transfer of rural surplus labor to cities,a special group of left-behind children in rural areas has been born.There are some problems in the groups of left-behind children,such as absence of legal guardianship,ineffective entrusted guardianship,anomie of group behavior,high crime rate and so on.We should clarify the responsibilities of guardians,introduce the guardianship supervision system,and comprehensively guarantee the realization of the guardianship rights and interests of the left-behind children through legal education and cultural services.
