摘要
如何通过编纂环境法典的规范方式落实可持续发展的要求,推动我国生态环境治理体系与治理能力现代化,是当前一个重要的课题,具有推动环境法基础理论发展、丰富环境法典总则内涵等方面的创新意义。域外代表性国家环境法典中均对环境治理相关内容进行了程度不一的规定。我国环境法典总则中应用专门章节规定“生态环境治理体系”,按照“1+3”逻辑理路展开:前者是基于现代环境治理体系要求的“生态环境监管体制”,包括基础性管理体制和特殊管理体制;后者是针对环境治理多元主体提出的规范性要求,具体分为党委与政府、企业、公众三个部分,规定其中的职权、权利与义务,为环境法典规范主体行为提供基本依据和指导性原则。本部分的内容对后续分则中的相关部分具有体系化的涵摄效力,也需要根据实际情况进行类型化处理。
How to implement the requirements of sustainable development through the normative way of compiling environmental code and promote the modernization of China’s ecological environment governance system and governance capacity is an important issue.It has the innovative significance of promoting the development of the basic theory of environmental law and enriching the connotation of the general provisions of environmental code.The application of special chapters in the general provisions of China’s Environmental Code stipulates the“ecological environment governance system”,which is carried out according to the“1+3”logic:the former is the“ecological environment supervision system”based on the requirements of modern environmental governance system,including basic management system and special management system;The latter is a normative requirement for multiple subjects of environmental governance,which is specifically divided into three parts:the CCP committee and the government,enterprises and the social public.
