国际投资仲裁反腐法治:概念、困难与因应

The Rule of Law for Anti-corruption in International Investment Arbitration:Concept,Difficulties and Settlement

跨国投资腐败是全球经济一体化的自然伴生与道德异化现象。反腐法治问题亦逐渐发展成为新近国际投资仲裁的焦点议题之一。国际投资仲裁反腐法治是推动构建“清洁美丽”人类命运共同体的必然要求与具体创新。面对国际投资仲裁反腐法治的种种现实困难,构思国际投资仲裁反腐法治的“良法善治”因应路径并进行具体施行方为上策。“清洁美丽”人类命运共同体理念考察下的国际投资仲裁反腐法治协作机制创建,是跨国投资腐败问题全球法治的中国方案与智慧贡献。创建ICSID与中国国家机关间的跨国投资反腐法治协作机制,是中国特色社会主义法治体系建设的有机组成部分。

Transnational investment corruption as a moral alienation naturally accompanies the global economic integration.The rule of law for anti-corruption gradually develops as one of the focal issues in recent international investment arbitration.The rule of law for anti-corruption in international investment arbitration is the inevitable requirement and concrete innovation in the promotion of constructing a“clean and beautiful”community with a shared future for mankind.When confronted with the real difficulties in the rule of law for anti-corruption in international investment arbitration,it is strongly proposed to design and implement the“good laws and good governance”settlement approach.Under the concept of a“clean and beautiful”community with a shared future for mankind,the establishment of an anti-corruption coordinative mechanism for the rule of law in international investment arbitration is China’s solution plan and wisdom contribution to combating transnational investment corruption in the way of global rule of law.The creation of the anti-corruption coordinative mechanism for the rule of law in combating transnational investment corruption between ICSID and domestic national organs becomes an integral part in the building of a socialist rule of law system with Chinese characteristics.
