国有农用地现状及市场化配置浅析

摘要 作为全民所有自然资源资产的重要组成部分,国有农用地因土地征收范围制约而被排除在政府划拨、有偿供地方式以外。在农业产业发展方面,受历史因素、经济模式影响,国有农用地也缺少集体所有向国家所有的转化机制,以及获取周边集体土地用益物权的有效途径。而且农民集体占用的国有农用地也因农民集体性质转变、集体土地入市等一系列改革而面临产权市场行为的合法化问题。只有解决好国有农用地面临的各种产权、交易等问题,才能全面推动国有农用地市场化配置体制机制的建立和完善。 Although state-owned agricultural land is an important part of natural resources and assets,it is out of government land expropriation and compensation because of some inherent constraints.Under the influence of historical issues and economy patterns,state owned agricultural land also indicates limited transfer mechanisms of land ownership from peasant collective to the state,as well as the shortage of accessibility to usufruct of adjacent agricultural land of peasant collective ownership.Furthermore,because of household registration system reform and marketization,state-owned peasant collective agricultural land faces legitimation of land rights.All these problems should be well resolved,and market configuration regimes and mechanisms of state-owned agricultural land can be established.
