Issues Concerning Notification and Commitment System of Fire Safety Administrative Licensing in the Context of Optimizing the Business Environment

以优化营商环境大背景下消防行政许可告知承诺制管理为切入点,立足前期试点工作经验和发现的问题,尝试从法理角度入手,破解当前告知承诺制实施过程中存在的火灾责任不明、失信行为追究等问题。紧密结合当前消防行政许可工作实际,从告知承诺制实施的法律原理、风险承担、优化完善等方面进行深入解读,切实解决消防行政许可告知承诺制在责任承担上的盲点。

This paper takes the management of the notification and commitment system of fire safety administrative licensing in the context of optimizing the business environment as its research subject. Based on the experience and problems found in the early pilot stage, solutions are explored to solve such problems as a lack of clarity regarding fire safety responsibilities and liability to dishonest acts in the implementation of notification and commitment system. The article combine the current fire administrative license work reality closely, interpret deeply from the legal principle of the implementation of information commitment system, risk bearing, optimization and improvement. The purpose is to solve the blind spots in the responsibility of the commitment system of fire administrative license.
