摘要
对网络文化产业进行有效法律规制,亟需在重新审视产业治理中法律适用范围的跨域性、法律主体身份的不确定性、法律客体行为的隐蔽性以及法律边际效应差序性的基础上重构网络文化产业法律治理的规范秩序,以厚植网络文化产业法律治理的伦理基础,推动多种治理手段一体协同,并通过加强代码规制和风险控制增强技术防范和法律治理能力。
The network culture industry has the characteristics of the cross-domain nature of the scope of law application,the uncertainty of the identity of the legal subject,the concealment of the legal object behavior and the differential order of the legal marginal effect.In order to realize the effective regulation of network culture industry,we need to reconstruct the standard order of legal governance of network culture industry on the basis of re-examination of industrial governance,take the ethical basis of legal governance of network culture industry,promote the integration of various governance means,and enhance the ability of technical prevention and legal governance by strengthening code regulation and risk control.
