算法视域下“通知-移除”规则的失范与重构--基于比例原则的考察

Anomie and Reconstruction of"Notice-and-takedown"Rule in the View of Algorithm--Investigation Based on the Principle of Proportionality

“通知-移除”规则作为互联网发展初期的制度产物,以人工审查为预设。在智能算法的加持下,“通知-移除”规则逐步向自动化侵权审查、预防性必要措施演进,加剧了网络空间侵权治理的比例失调风险。为促使“通知-移除”规则的算法实施实现理性回归,我国应在比例原则“适当”“必要”“均衡”的规范指引下,积极探寻“通知-移除”规则算法施行的比例协调之道,以严格形式要件的合格通知、区分性适用的必要措施以及合理使用情形的利益衡量实现规则适用的最佳状态。

The"Notice-and-takedown"rule,as an institutional product in the early stage of the development of the Internet,is presupposed by manual review.With the blessing of intelligent algorithm,the rule of"Notice-and-takedown"gradually evolves to automatic tort review and preventive necessary measures,which aggravates the risk of proportional imbalance in cyberspace tort governance.In order to promote the implementation of the algorithm of"Notice-and-takedown"rule to realize rational regression,our country should actively explore the way of proportional coordination of the implementation of the algorithm of"Notice-and-takedown"rule under the normative guidance of"appropriate","necessary"and"equilibrium".The best state of the application of the rules should be measured by the qualified notification of strict formal elements,the necessary measures of differentiation and the interests of reasonable use cases.
