Legal Protection of Live Sports Event Images under the Perspective of the New Copyright Law

纵观体育赛事直播产业,核心资源在于赛事版权。现行司法实践对体育赛事直播画面的法律性质认定仍存分歧,导致产业界在发展体育赛事相关产业时可预见性仍有不足。在最新修订的《著作权法》中,视听作品和录像制品二元结构仍将并存,如何为体育赛事直播画面定性,成为当前司法实践亟待解决的问题。随着内容付费商业形态日趋成熟,学界应当立足互联网新形势,借鉴域外有益经验并结合我国国情,合理解决体育赛事直播画面的保护难题。

Throughout the live sports event industry,the core resource lies in the copyright.The current judicial practice is still divided on the legal nature of live sports footage,which leads to a lack of predictability in the development of sports-related industries.In the newly revised Copyright Law,the binary structure of audiovisual works and video products will still coexist,and how to characterize live sports event footage has become an urgent issue to be resolved in current judicial practice.With the increasing maturity of the commercial form of content payment,the academic community should base on the new situation of the Internet,draw on the beneficial experience of foreign countries and combine with China’s national conditions to reasonably solve the difficult problem of protecting live sports event images.
