Bridging the Global Digital Divide:Where Will the International Law Go

当今世界正处于百年未有之大变局,新冠肺炎疫情全球大流行加剧了各种变数的不确定性,数字经济趁机逆流而上,成为一股清流、引领世界经济走出低迷。但对于全球、特别是发展国家而言,能够有效获取和使用数字资金、技术和手段严重不足,与发达国家之间固有的数字鸿沟进一步扩大,甚至衍生为数字殖民主义。不公正的国际经济秩序,私有化、自由化与网络空间主权对立,属地管辖的标准难以识别,这些诱因都是发达国家主导国际法弥补鸿沟失灵的重要推手。据此,构建"新的世界信息和通信秩序",协调数字开放与网络空间主权冲突,修正属地管辖标准的缺陷,为发展中国家匡扶国际法正义指引了方向。尤其是中国政府提出打造网络空间命运共同体,引领数字开放与网络安全规则,开启跨境数字执法机制新模式,这些努力为弥合全球数字鸿沟注入了中国理念、中国智慧和中国贡献。

Today’s world is undergoing major changes unseen in a century.The COVID-19 global pandemic has exacerbated various uncertainties.The digital economy takes the opportunity to go upstream and become a clear stream,leading the world economy out of the downturn.However,for the world,especially the developing countries,due to the effective access and use of digital funds,and serious insufficient technology and means,the inherent digital gap with the developed countries has been further expanded,and even derived from digital colonialism.There are some important driving forces such as the unjust international economic order,privatization,liberalization and cyberspace sovereignty are in opposition,and the standards of territorial jurisdiction are difficult to identify,trigger developed countries the failure of the international law to bridge the gap.Accordingly,the construction of a"new world information and communication order",coordinated the conflict between digital openness and sovereignty in cyberspace,corrected the defects of territorial jurisdiction standards,all these measures give the direction for developing countries to support the justice of international law.In particular,the Chinese government has proposed to build a community with a shared future in cyberspace,lead digital openness and cyber security rules,and open up a new model of cross-border digital law enforcement mechanism.These efforts have injected Chinese philosophy,wisdom and contribution to bridging the global digital divide.
