从弹性视角看民族地区自然保护区法律制度的实施

On the Implementation of the Legal System of Nature Reserves in Minority Areas from the Perspective of Flexibility

自然保护区的建设与发展不仅涉及环境保护问题,也涉及民族地区的可持续发展与社区居民的权益保障。不仅需要自然保护区法律体系的完善,更需要在实践中发挥制度措施和管理手段的实效性。生态环境与人类社会作为一个密不可分的复杂系统,其中产生的问题需要用整体性与跨学科思维来解决。面对我国自然保护区法律制度实施中的困境,应结合生态学弹性思维、民族法学少数民族权利保障、环境法学公众参与等学科理论来进行分析。通过吸取实践治理经验,因地制宜地采取灵活的管理措施,充分借鉴地方少数民族的传统知识。同时保障社区居民的积极参与并建立多元化的协商治理机构,以促使自然保护区法律制度与管理机制得以有效运行。

The construction and development of nature reserves involves not only the environmental protection,but also the sustainable development of minority areas and the protection of community residents′rights and interests.The leagal system of nature reserves not only needs to be improved,but also needs to give play to the effectiveness of institutional measures and management means in practice.As an inseparable complex system,ecological environment and human society need to solve the problems with holistic and interdisciplinary thinking.In the face of the difficulties in the implementation of the legal system of nature reserves in China,it should be analyzed by combining the theories of ecology flexible thinking,minority rights protection of ethnic law,public participation of environmental law and other disciplines.We should learn from the experience of practical governance,adopt flexible management measures according to local conditions,and fully learn from the traditional knowledge of local ethnic minorities.At the same time,we should ensure the active participation of community residents and establish a diversified consultative governance mechanism to promote the effective operation of the legal system and management mechanism of nature reserves.
