作品独创性判断的司法判例与理论分析

Judicial precedent and theoretical analysis of originality judgment of works

独创性作为作品构成要件之一,存在概念模糊及判断标准缺失等问题。以171份判例为研究对象,借助量化归纳方式分析我国法官对独创性的普遍理解。在此基础上提出:以“最低限度的创作程度、高度”为统一标准,让法官对独创性进行独立判断;以“意图—行为—成果”为路径进行独创性判断,兼顾差异度、选择空间的大小等影响因素;在独创性之外寻求利益平衡。

Originality,as one of the constituent elements of works,has some problems such as vague concepts and lack of judgment standards.Taking 171 cases as the research object,this paper analyzes judges′general understanding of originality by means of quantitative induction.On this basis,it is proposed that judges can judge the originality independently with"the minimum degree and height of creation"as the unified standard.Originality judgement can also be made with"intention-behavior-achievement"as the judgment path,taking into account the influencing factors such as the degree of difference and the choice space.And adopting the minimum standard of originality will not lead to the imbalance of interests.
