珐琅工艺创新发展中的知识产权保护研究

Intellectual Property Protection in the Development of Enamel Process Innovation

党的十八大以来,国家高度重视传统手工艺的发展。十八届五中全会提出“构建中华优秀传统文化传承体系,加强文化遗产保护,振兴传统工艺”的要求,并将“振兴传统工艺”写入“十三五”发展规划,制定实施中国传统工艺振兴计划,推动传统手工艺传承和创新发展。在振兴传统手工艺的背景下,珐琅工艺具有重要的价值,在传承与发展中知识产权保护必不可少。通过实地调研、数据检索与分析、政府文件解读等手段,分析珐琅工艺的发展状况和知识产权保护状况,针对珐琅工艺发展中知识产权保护存在的问题,提出需提高珐琅工艺从业者的知识产权意识、全方位构建法律保护体系,建立与珐琅工艺有关的知识产权保护机制,强化地区间知识产权行政保护协作、优化知识产权保护环境、加强珐琅工艺人才队伍建设。

Since the 18th National Congress of the Communist Party of China(CPC),China has attached greater importance to the development of traditional handicrafts.The Fifth Plenary Session of the 18th CPC Central Committee put forward the requirements of“building a system for inheriting excellent Chinese traditional culture,strengthening the protection of cultural heritage and revitalizing traditional crafts”.The“revitalization of traditional crafts”is written into the 13th Five-year Plan for Economic and Social Development of the People's Republic of China,and the revitalization plan of traditional Chinese crafts was formulated and implemented to promote the inheritance and innovative development of traditional handicrafts.As a traditional handicraft in China,enamel craft has important value,and intellectual property protection is essential in inheritance and development.The paper analyzes the development status of enamel technology and the status of intellectual property protection through field investigation,data retrieval and analysis,and interpretation of government documents,aiming at finding out the intellectual property protection problems in the development of enamel craft.In view of these problems,it is thus proposed that the awareness of intellectual property of enamel craft practitioners should be raised,the legal protection system should be built in all directions,the intellectual property protection mechanism related to enamel craft should be established,the cooperation of administrative protection of intellectual property between regions should be strengthened,the environment of intellectual property protection should be optimized,and the construction of enamel craft talents should be strengthened.
