非法养殖受污致损案件法律适用问题研究

Research on the Application of Law in the Case of Pollution and Damage Caused by Illegal Farming

非法养殖受污致损案件存在养殖行为合法性判定标准不同、责任承担范围各异等问题,解决这些问题可以在司法实践中明确该类案件的裁判规则,从而保护当事人的合法权益。从法律适用的角度,运用法律解释方法在侵权责任法矫正正义的理论基础上,从立法目的角度解释适用相关规则。发现实践中养殖行为的合法性认定以及责任承担范围的具体问题。最终分析结合实践情况总结出关于非法养殖受污致损的裁判规则:渔业生产者未经相关行政主管部门许可,非法占有水域进行养殖,主张污染者对因排污而造成的损失进行赔偿的,对于鱼苗、饲料类生产成本的部分应当赔偿损失;对于其实施非法养殖行为的人工费、预期收益损失部分,因不属于合法民事权益,不应当赔偿该部分损失。

In the case of pollution and damage caused by illegal farming,there are problems such as different standards for judging the legality of farming behaviors and different scopes of responsibility.To solve these problems,the judgment rules of such cases should be clarified in judicial practice,so as to protect the legitimate rights and interests of the parties.From the perspective of the application of law,the legal interpretation method is used to explain the application of relevant rules from the perspective of legislative purposes based on the theory of justice correction of tort liability law.Discover the specific problems of the legality of breeding behavior in practice and the scope of responsibility.Finally,based on the analysis and practice,the judgment rules on pollution caused by illegal farming are summarized:fishery producers illegally occupy waters for aquaculture without the permission of relevant administrative department,and claim that the polluter should compensate for the losses caused by pollution discharge.The part of the production cost of fish fry and feed should be compensated for losses;the part of the labor cost and expected profit loss of the illegal breeding activities should not be compensated for because it is not a legal civil right.
