恐怖主义全球治理失灵的国际制度根源

Origins of Dysfunction of Global Governance on Terrorism

当前全球范围内恐怖主义的根源依然存在,在现有的国际制度下,恐怖主义全球治理处于失灵状态。而国际制度在恐怖主义全球治理中难以发挥作用的根由有四:从性质上看,恐怖主义全球治理中的国际制度具有一般国际制度普遍具有的内在矛盾;从主体上看,各主体在反恐国际制度内部和外部争夺恐怖主义全球治理主导权;从理念上看,多重理念造成国际制度中的"价值破碎化"现象;从内容上看,国际制度内容的广泛性和复杂性致使国际制度实施过程中在实质和程序上的刑罚困境。上述问题会使反恐国际制度在恐怖主义全球治理过程中产生制度内部和制度之间的双层矛盾和冲突,最终导致恐怖主义全球治理的失灵。

The fact that sources of terrorism still exist worldwide illustrates that under the established international institutions,global governance on terrorism is unsuccessful or in condition of malfunction to a large extent.Four reasons are discussed for why it is difficult for international institutions to function in global governance on terrorism.From the nature of global governance,it possesses some inner contradictions that all of international institutions generally posses.From the subjects of global governance,it consists of national actors and non-national actors contend,and different subjects are fighting for the dominant right over counterterrorism global governance.From the philosophies of global governance,counterterrorism international institutions contain multiple but conflicting philosophies,which bring about value fragmentation in institutions.From the contents of global governance,counterterrorism international institutions are extensive and complex and incur substantial and procedural difficulties in the implementation process of institutions.These conflicts may incur both internal and external dual contradictions and conflicts in the implementation process,and result in dysfunction in global governance.
