村级职务犯罪刑事规制的困境与出路

Dilemma and Way Out of Criminal Regulation of Duty Crime at Village Level

我国村级自治权力结构表现出经济改革驱动、党的统一领导、与政府关联密切等特征,其中发生的腐败现象也具有复杂性。因此采取广义视角即包括国家公务和非国家公务的职务概念研究村级职务犯罪。村级职务犯罪刑事规制的困境包括:职务认定和罪名定性存在模糊和混乱、本罪及关联犯罪的规制存在空白和漏洞、刑事处理中存在相对失衡等。在此基础上,提出完善村级职务犯罪刑事规制的协调统一原则、惩罚和预防并重原则以及健全乡村治理体系与实现程序法治原则。完善村级职务犯罪刑事规制的对策包括:进一步规范对村级职务犯罪的司法适用;完善刑事立法及相关罪刑体系;加强基层民主建设,完善村民自治等。

There are some characteristics in our village level autonomy such as driven by the economic reform,the unified leadership of the Party and close association with the government,therefore the village level corruption phenomenon is a mixed existence.So the research of village level duty crime is based on generalized concept of duty including national and non-national nature.Dilemma of criminal regulation of duty crime at village level includes fuzzy and confusion of judicial determination on the duty and accusation,loopholes in criminal regulation of duty crime and relevant crimes,imbalance in criminal treatment of duty crime at village level.The principle of coordination and unification,the principle of equal attention to prevention and punishment and the principle of perfecting rural ruling system and realizing procedural rule of law are put forward.Countermeasures to perfect criminal regulation of duty crime at village level include the normalization of judicial application,the perfection of legislation of crime system,the strengthening of democratic construction at the basic level and the promotion of villagers'self-governance.
