摘要
高价值发明专利一直是知识产权界的关注焦点,对于促进产业升级和建设知识产权强国具有重要作用。到底何为高价值发明专利,目前学术界和实践领域还没有统一的定义与界定标准。对于高价值发明专利的界定,不能仅从某个单一的维度进行研究分析。实际上,高价值发明专利是一个综合性的集多重属性于一体的集合。文章通过对现行界定标准的解读与评判,并在此基础上构建出新的高价值发明专利的界定标准,具体包括战略价值、技术价值、法律价值以及市场价值这四大属性特征。同时针对这四大属性进行细化,明确相应的二级指标,以期为高价值发明专利的界定提供借鉴和参考。
High-value invention patents have always been the focus of the intellectual property community and play an important role in promoting industrial upgrading and building an intellectual property power.As for what is a highvalue invention patent,there is currently no unified definition and standard for definition in the academic and practical fields.The definition of high-value invention patent cannot be interpreted from a single dimension.In fact,high value invention patent is a comprehensive set of multiple attributes in one.Through the interpretation and evaluation of the current standards,this study builds a comprehensive standard for high-value invention patents including the four attributes of strategic value,technical value,legal value,and market value.Also,this study refines these four attributes and clarifies the corresponding secondary indicators,to provide reference for the definition of high-value invention patents.
