农宅合作社的实践特色与制度完善--以农村宅基地“三权分置”改革为背景

The Practical Characteristics and System Perfection of Rural Housing Cooperatives--Based on the Background of the Reform of“Separation of Three Rights”in Homesteads

农村宅基地“三权分置”政策公布以来,各地积极实践,出现了包括农宅合作社在内的农村宅基地及农宅利用形式的创新探索。目前立法尚未对此政策予以法律界定。在充分肯定农宅合作社在农宅合作开发、社会资源利用、新型产业运作、助力乡村振兴等方面的积极作用的同时,应把握保障性优先、规范性运行,部门联动、系统推进,找准社会工商资本与闲置宅基地对接的结合点,保障政策的红利得到正确释放。

Since the publication of the policy of“separation of three rights”in homesteads,there have been active practices in various places,and innovative explorations have emerged in the form of utilization of rural homesteads and houses,including rural housing cooperatives.The current legislative status adopts a steady and mature orientation,which has not yet been legally defined.While fully affirming the positive role of rural housing cooperatives in the cooperative development of rural houses,the utilization of social resources,the operation of new industries and the revitalization of rural areas,we should grasp the priority of security,normative operation,departmental linkage,systematic promotion,identify the integration point of social industrial and commercial capital and idle homesteads,and ensure that the dividends of the“separation of three rights”reform policy of homesteads are properly released.
