电信网络诈骗犯罪的全球治理理念与机制研究

电信网络诈骗犯罪已然成为当前发展最快、危害最大的刑事犯罪类型,低成本、高收益是其高发的驱动力。多元化的治理主体和多层次的治理机制相耦合,为电信网络诈骗犯罪的全球治理提供了全新的解决思路。其中,规制个人信息跨境流通,是破除电信网络诈骗犯罪的前置条件,是治理电信网络诈骗犯罪的关键点。另外,在缺乏统一机制的情况下,国际法治与国内法治应当紧密联系、互相配合,到达“善治”的共同目的。不仅如此,还应发挥软法的作用,比如电信网络经营者、金融机构等组织的自主监管等。从全球治理视域研究电信网络诈骗犯罪治理的理念与机制,形成化解社会风险的协同治理能力,在理论和实践上都具有重要价值。

Telecommunication network fraud crime has become the fastest growing and most harmful type of criminal crime.Low cost and high income are the driving forces for its high incidence.The coupling of diversified governance bodies and multi-level governance mechanisms provides brand-new solutions for the global governance of telecommunication network fraud crimes.Among them,regulating the cross-border circulation of personal information is a prerequisite for the elimination of telecommunication network fraud crimes and a key point in the governance of telecommunication network fraud crimes.In addition,in the absence of a unified mechanism,the international rule of law and the domestic rule of law should be closely linked and coordinated to achieve the common goal of“good governance.”And play the role of soft law,such as the independent supervision of telecommunication network operators,financial institutions and other organizations.From the perspective of global governance,it is of great value in theory and practice to study the concept and mechanism of the governance of telecommunication network fraud crime,and to form a collaborative governance ability to resolve social risks.
