图书馆信息网络传播权限制与例外研究:缘起、现状与走向

Research on Limitations and Exceptions of Library Information Network Communication Right:Origin,Current Situation and Trend

图书馆数字资源传播受到版权法的规制,厘清图书馆数字资源传播行为法律边界对图书馆数字化转型具有重要意义。基于国际版权法与部分国家国内版权法法律文本,采取比较研究的方法,对当前信息网络传播权保护和图书馆基于文献提供或馆际互借所享有的信息网络传播权限制与例外进行梳理和分析。国际公约及各国版权法对于面向图书馆数字资源传播法律边界的塑造集中体现在“明确适用主体为图书馆”以及“明确适用主体为网络信息提供者但图书馆可援引”两方面,对图书馆数字资源传播合法性影响要素进行了分析并从4方面提出图书馆信息网络传播权限制与例外立法策略。

The spread of library digital resources is regulated by copyright law,and It’s of great significance to clarify the legal boundary of the dissemination of library digital resources for library digital transformation.Based on the international copyright law and some domestic copyright law texts,this paper adopts the method of comparative study to sort out and analyze the current protection of information network communication right and the restrictions and exceptions of information network communication right enjoyed by libraries based on literature provision or interlibrary loan.International conventions and copyright laws of various countries have shaped the legal boundaries of the dissemination of digital resources for libraries,which are embodied in two aspects:“it is clear that the subject of application is the library”and“it is clear that the subject of application is the network information provider but the library can invoke”.The article analyzes the factors affecting the legitimacy of library digital resource dissemination from three aspects and proposes legislative strategies for the limitation and exception of library information network dissemination rights from four aspects.
