摘要
大数据时代,信息已然发展成为一种具有独特价值的资源。体育明星拥有的信息本身附属于人之本体,具有静态的专属性和人格性;信息表达附着于物之载体,具有动态的流动性和经济性。鉴于此,须先甄别体育明星个人信息的社会独特性及其与隐私的区分性;继而在对涉及体育明星个人信息保护规范进行筛检和评析的基础上,通过引入共时性的“场景风险理论”对信息主体予以类型划分,具体包括原生性信息主体的体育明星个人、过程中的体育数据组织和国家体育组织;最后以历时性教义学理论揭示多极主体之间的权利与义务规则。
In the era of big data,information has become a resource with unique value.The information owned by sports stars is of static specificity and personal feature.Information expression is attached to the material carrier and is of dynamic fluidity and economy.It is necessary to distinguish the social uniqueness of sports stars’personal information from its distinction with privacy.The types of information subjects are divided based on the examination and evaluation of the personal information protection norms of the sports stars.This division introduces synchronic“scenario risk theory”,including the sports stars as the original information subject,sports data organizations in the process and national sports organizations.The diachronic dogmatics theory reveals the rules of rights and obligations between the multipolar subjects.
