摘要
劳动者因相对弱势而受到劳动法的倾斜性保护,但企业的高级管理人员不同于一般劳动者,高级管理人员在企业管理权限、人格从属性、薪酬水平以及与用人单位谈判力都所不同。而我国劳动立法未区分一般劳动者与高级管理人员,所以本文在借鉴境外劳动法关于管理管理人员的规定上,明确我国劳动法的高级管理人员含义。结合提出实践中高级管理人员适用劳动法的工时制度、工资制度以及解除保护制度三个方面的突出问题,并给出解决这些问题的建议。
Workers are protected by the labor law because of their relative weakness,but senior executives of the enterprise are d ifferent from the ordinary workers in the enterprise management authority,personality subordinate attributes,Salary levels and negotiation skills.However,China's labor legislation does not distinguish between ordinary workers and senior executives,so this paper makes clear the meaning of senior executives in China's labor law by drawing lessons from the regulations of foreign labor law on senior executives.This paper puts forward three prominent problems in the application of labor law to senior executives in practice,such as working hours system,wage system and lifting protection system,and gives some suggestion to solve these problems.
