Transformation of the Judicial Paradigm in the Digital Age

现代司法范式经历了形式司法、实质司法、协商司法的形态演变,其演化动力来自于外部的社会条件变化,以及司法实践的内部反思。信息化背景下,现代司法范式面临三重挑战:一是双重空间对司法场域形成的冲击,二是平台治理对国家法律中心主义和司法至尊地位的消解,三是司法智能化的转型张力。数字时代,我们需要立足于后现代社会的生产方式、生活方式、行为方式和价值观念等深度变革的客观因素,为司法价值注入数字正义的内涵,推动演绎逻辑与计算知识的融合运用,探索数据驱动型纠纷预防。

The modern judicial paradigm has undergone a morphological evolution of formal justice,substantive justice,and consultative justice,and its evolution is driven by changes in external social conditions as well as internal reflections on judicial practice.In the context of information technology,the modern judicial paradigm faces a triple challenge:first,the impact of dual space on the formation of the judicial field;second,the elimination of national legal centralism and judicial supremacy by platform governance;and third,the transformation tension of judicial intelligence.In the digital era,we need to base on the objective factors of the profound transformation in production,lifestyle,behavior,and values of post-modern society,inject the connotation of digital justice into judicial values,promote the integration and use of deductive logic and computational knowledge,and explore the prevention of data-driven dispute.
