我国《体育法》修订进程中体育仲裁制度的构建与完善

Development of an Arbitration System for Sport When Amending the Law of the People’s Republic of China on Physical Culture and Sports

构建我国独立的国内体育仲裁机制,是正在进行的我国《体育法》修订工作的重要内容。在近期公布的《中华人民共和国体育法(修订草案)》中,体育仲裁被设置为专章,通过立法确立了我国独立的体育仲裁制度。相较普通民商事仲裁,体育仲裁在立法目的、基本原则、基本制度和具体规则等方面有其特殊性。研究以《体育法》修订进程中有关体育仲裁的讨论为脉络,归纳总结体育纠纷内部解决机制及外部化解方式的差异性和共性,以开放的眼光寻求体育仲裁体系化立法的合力,系统梳理总结体育仲裁基本原则、基本制度和具体规则。以"法定+约定"的思路和方法给修订草案中的体育仲裁内容提出意见,为建立专门的、完整的、具有中国特色的体育仲裁制度及完善我国体育仲裁立法提供建议。

Developing an independent domestic arbitration mechanism for sport in China is an important part of the ongoing amendments to the Law of the People’s Republic of China on Physical Culture and Sports.In the recently published draft amendment to this Law,an independent chapter has been specifically dedicated to arbitration for sport,in other words,China’s independent arbitration system for sport has been established through legislation.Compared with general civil and commercial arbitration,arbitration for sport has its particularity in terms of legislative purpose,basic principles,basic systems and specific rules.This research takes the discussion on arbitration for sport when amending the Law of the People’s Republic of China on Physical Culture and Sports as the research framework,summarizes the differences and commonalities between the internal and external settlement mechanisms for sport-related disputes,seeks the synergy for systematic legislation on arbitration for sport with an open vision,and systematically summarizes the basic principles,basic systems and specific rules regarding arbitration for sport.This paper also offers opinions on the above-mentioned draft amendment based on an“statutory and contractual”approach,with a view to providing suggestions for establishing a sound specialized arbitration system with Chinese characteristics for sport and improving China’s legislation on arbitration for sport.
