我国畜禽养殖废弃物污染防治法律问题及完善

针对我国畜禽养殖废弃物污染防治立法方面存在的法律适用范围较窄、上下位法相冲突,部门之间权责交叉且无专门监督管理机构,缺乏公众参与长效机制等问题,提出应完善立法,特别是对畜禽非规模养殖进行法律规制,理清部门之间的关系,做到权责明确,建立畜禽养殖废弃物污染防治专门管理机构以及完善公众参与机制,加强个人、养殖户和社会团体的参与力度等建议。

The problems existing in the legislation on pollution prevention and control of livestock and poultry breeding waste in our country are analyzed,such as the scope of application of the law is narrow,and the upper and lower laws are in conflict;the rights and responsibilities between different departments are unclear and there is no special supervision and management agency;lack of long-term mechanism of public participation.It is proposed that legislation should be improved,especially the legal regulation of non-scale livestock breeding,clarify the relationship between departments,make the rights and responsibilities clear,and stablish a special management organization for pollution prevention and control of livestock and poultry waste,improve the public participation mechanism,and strengthen the participation of individuals,farmers and social groups.
