摘要
2021年7月16日,卢森堡国家数据保护委员会发布了一项针对亚马逊欧洲(以下简称“亚马逊”)的处罚决定,声称其对个人数据进行行为分析和定向广告不符合《欧盟通用数据保护条例》。该决定对亚马逊处以7.46亿欧元的罚款,并要求进行整改,这是迄今为止依据GDPR做出的最高罚款。目前,卢森堡当局尚未公开本案的具体决定,但数例相似的处罚已然表明,关注隐私合规与数据保护的欧美国家正对企业的用户行为分析和定向广告活动实施越来越严格的管控,其规制的规律不仅对国内企业的隐私合规极为重要,也能够为国内立法、司法活动提供相当的借鉴意义。
On 16 July 2021,the National Data Protection Commission of Luxembourg issued a penalty decision against Amazon Europe Core S.a.r.l("Amazon"),claiming that its behavioral analysis of personal data and targeted advertising did not comply with the EU General Data Protection Regulation("GDPR").The decision imposes a fine of€746 million on Amazon and requires rectification,which is the highest fine ever imposed under the GDPR.The Luxembourg authorities have not yet made public the specific documents,but several similar penalties have shown that European and American countries,which are concerned about privacy compliance and data protection,are imposing increasingly strict controls on companies'user behavioral analysis and targeted advertising activities,and that the rules of their regulation are not only of great importance for domestic companies'privacy compliance,but can also provide considerable lessons for domestic legislative and judicial activities.
