摘要
作品名称不仅有作品来源的指示功能,还是作品社会评价凝结的符号,在经济活动中具有独特商业价值。作品名称的商业价值具有不确定性,贸然采用商品化权并不合适,作品名称保护也不能简单套用商标权或著作权模式,竞争法保护路径从维护公平的竞争秩序出发,有助于发挥其调整制度间的交叉或空白地带的特有作用。
The name of the work not only has the function of indicating the source of the work, but also is the symbol of the condensation of the social value of the work, and has unique commercial value in economic activities. The commercial value of the name of a work is uncertain, so it is not appropriate to use merchandising right hastily, and the rights and interests of the title of works cannot be simply protected by trademark law or copyright law. The protection path of the competition law starts from the maintenance of fair competition order, which is helpful to play its unique role of adjusting the intersection or blank space between systems.
