金融科技“监管沙盒”测试项目豁免制度研究

金融科技的快速发展推动着传统金融与监管的革新,一种新型监管方式即金融科技“监管沙盒”应运而生。在金融科技“监管沙盒”实践中,测试项目豁免制度突破了原有监管规则的掣肘,成为金融创新的必然要求,被普遍接受并付诸实践。我国应通过制定金融科技监管法律、国务院决定及部门规章等,设定金融科技“监管沙盒”测试项目豁免许可,并对豁免的申请、受理、审核、复议、监督等程序性规定及豁免标准、权益保护要求、应急预案、范围、形式等实体性规定进行具体规制,从而构建完备的金融科技“监管沙盒”测试项目豁免制度。

The rapid development of financial technology promotes the innovation of traditional finance and supervision,and a new mode of supervision,namely“regulatory sandbox”has come into being.In the practice of“regulatory sandbox”,the exemption system of test project has broken through the constraints of traditional regulatory rules.It has become the inevitable requirement of financial innovation,and has been widely accepted and put into practice.China should set up exemption license for financial technology“regulatory sandbox”test project by formulating financial technology regulatory laws,decisions of the State Council,and departmental rules.The procedural provisions on application,acceptance,review,reconsideration,and supervision,etc.,as well as the substantive provisions on exemption standard,right and interest protection requirement,emergency plan,scope,and form,etc.should be specifically regulated,so as to build a complete exemption system of test project of“regulatory sandbox”of financial technology.
