Research on the Implementation Mechanism of Supervision Proposals

《监察法》赋予了监察机关就监察对象所在单位廉政建设和履行职责存在的问题提出监察建议的权力。实践中,监察建议在推动监察对象所在单位以案促改、以案促治的方面发挥了重要作用。《监察法》关于监察建议的规定较为原则,《政务处分法》《公职人员政务处分暂行规定》及部分地方规范性文件中虽有涉及监察建议的具体规定,但相关规定既未形成完整的体系,也与《监察法》上的监察建议存在区别。这导致理论上对监察建议的定性、主要功能与适用范围的认识不一等问题。实践中监察机关在监察建议的适用情形、实施程序、监督约束方面的做法也不尽相同,统一规范的监察建议实施机制并未形成。为解决此问题,《监察法实施条例》就监察建议的适用范围、监察建议书主要内容等问题进行了明确规定,但其实施机制仍有完善的空间。要充分发挥监察建议的功能,既要在理论层面进行厘清,也需要在制度建设层面再进行统一规范,并注重具体实施机制的落实。

The Supervision Law gives the supervisory authority the power to make supervisory recommendations on the problems of integrity construction and performance of duties in the units where the supervisory subjects are located.In practice,supervisory recommendations have played an important role in promoting the units where the supervisory subjects are located to promote reform and governance by means of cases.The provisions of the Supervision Law on supervision proposals are more principled,and although there are specific provisions involving supervision proposals in the Law on Administrative Punishment,the Interim Provisions on Administrative Punishment for Public Officials,and some local normative documents,the relevant provisions neither form a complete system nor differ from the supervision proposals on the Supervision Law.As a result,the theoretical understanding of what is a supervisory proposal,its main functions and scope of application varies,and the practice of supervisory organs in the application of supervisory proposals,implementation procedures,supervision and constraints also varies,and a unified and standardized mechanism for the implementation of supervisory proposals has not been formed.To solve this problem,the Implementing Regulations of the Supervision Law clarify the scope of application of supervisory recommendations and the main contents of supervisory proposals,but there is still room for improvement in its implementation mechanism.To give full play to the function of supervision proposals,it is necessary to clarify them at the theoretical level as well as to unify and regulate them again at the level of institutional construction,and to focus on the landing of specific implementation mechanisms.
