德国实施开放性难民政策的现实考量与启迪借鉴

On the Practice and Enlightenment of Germany’s Open Refugee Policy

开放性难民政策的实施为德国赢得世界赞誉的同时,也使其内外交困,深陷难民危机的泥潭。作为负责任的大国,中国始终积极响应联合国难民署的号召,为解决世界难民问题建言献策出力。目前中国尚未制定专门的难民法,难民治理的相关立法非常有限,尽管没有出现大规模难民涌入、难民暴乱等极端事件,但是反思德国实施开放性难民政策的理论缺陷与实践困境,仍需居安思危、未雨绸缪,在“人类命运共同体”理念的引领下毫不动摇地坚持国家安全原则与人道主义救助相统一,审慎地、渐进地构建中国难民治理体系。

The implementation of the open refugee policy wins Germany the world praise,but simultaneously makes it trapped inside and outside,deep in the quagmire of refugee crisis.As a responsible major country,China has always responded to the call of the UN High Commissioner for Refugees and made suggestions and contributions to solving the world refugee problem.At present China has not yet made any special refugee law,which makes its refugees governance legislation limited.Although there are not a large number of refugees,refugees riots or other extreme events,the reflection of the theoretical defects and practical difficulties of Germany’s open refugee policy is still necessary.Unswervingly adhering to the unity of national security principles and humanitarian assistance under the guidance of the concept“a community with a shared future for mankind”,will help to build a refugee governance system in China.
