再论1938年版《鲁迅全集》的版权问题

Rediscussion on the Copyright of the 1938 Edition of the Complete Works of Lu Xun

1938年版《鲁迅全集》的版权问题,有认为其涉嫌侵权。根据1928年《著作权法》等法律规定的条文,1938版《鲁迅全集》的出版只需要得到著作权人的同意即可,不必以收回北新书局等出版机构的鲁迅遗著出版权为前提。李小峰同意由第三方出版《鲁迅全集》且对出版时间未设限。这种正面态度有助于消除王云五对于北新书局“反诉”的疑虑,也有利于《鲁迅全集》尽早出版。《鲁迅全集》出版过程中并未侵犯北新书局的权益,也不存在侵权问题。在民国法律框架下,1938年版《鲁迅全集》一经注册,其著作权(编辑著作权)就应归“鲁迅先生纪念委员会”所享有。

Some researchers have questioned the copyright of the 1938 edition of the Complete Works of Lu Xun,believing that it is suspected of infringement.According to the spirit of legal norms such as the“Copyright Law”of 1928,the publication of the 1938 edition of the Complete Works of Lu Xun only needs the consent of the copyright owner,and does not have to take back the publishing copyright of Lu Xun’s legacy from publishing institutions such as Beixin Book Company.Li Xiaofeng agreed to publish the Complete Works of Lu Xun by a third party and there is no limitation on the publication time.This positive attitude helps to eliminate Wang Yunwu’s doubts about the“countersuit”of Beixin Publishing House,and is also conducive to the early publication of the Complete Works of Lu Xun.The Complete Works of Lu Xun did not infringe the rights and interests of Beixin Book Company during the publishing process,and there was no infringement problem.Under the legal framework of the Republic of China,once the 1938 edition of the Complete Works of Lu Xun was registered,its copyright(editing copyright)should belong to the“Mr.Lu Xun Memorial Committee”.
