摘要
环境行政执法与刑事司法衔接工作作为生态环境治理保护的重要一环,虽在各地均得到实践并取得了相应的成效,但现实中还存在“行政本位”思想根深蒂固、立法位阶较低等问题,导致环境“两法”衔接工作在实施过程中遭遇重重困难。基于环境协同治理和“两法”衔接的内在一致性,从执法人员、立法效力、部门配置等方面出发,提出完善建议,以期构建良性的“两法”衔接机制。
Environment“reduced”to connect and work as one of the most important aspects of the management and protection of ecological environment,is all over the country were practice and obtain the corresponding results,but the reality is“administrative”thought deeply rooted,legislative status is low,the case is transferred for standard is not clear,lead to the linkage between the environmental administrative law enforcement and criminal justice encounter difficulties in the implementation process.Based on the internal consistency of environmental collaborative governance and the convergence of the“Two Laws”and“Two Laws”,this paper puts forward suggestions for improvement from the aspects of law enforcement personnel,legislative effectiveness,and departmental allocation,so as to build a benign convergence mechanism of the“Two Laws”.
