行政规范性文件的“规范性”标准及其运用——以S省卫健委的行政规范性文件为观察对象

On Normative Standards and Application of Administrative Normative Documents--Taking Administrative Normative Documents of S Provincial Health Commission as the Observation Object

行政规范性文件首先应具备“规范性”才有可能起到规范的作用。从现行相关法律、法规、规章和政策中,可归纳出考量行政规范性文件之“规范性”的指标为制发主体合法,程序合法,内容合法、合理、必要和协调,文字使用准确;而据此对S省卫健委在其官网上发布的行政规范性文件作考察可见,其合法性审查机制确实起到了较好的效果,但其在发布程序上还存在瑕疵,对上位法内容的重复率较高,相互之间的协调性还不够,文字使用的准确度还有待加强。鉴此,应从“程序透明”、制定目的和配备专业人员方面入手,以提高其“规范性”。

The normative documents of administrative law enforcement must be"normative"before they can play a normative role.From the existing relevant laws,regulations,rules and policies,we can sum up the following in⁃dicators to consider the"standardization"of administrative normative documents:legal preparation and issuance sub⁃ject,legal procedure,legal content,rationality,necessity and coordination,and accurate use of words.According to these standards,through the investigation of the administrative normative documents released by S provincial Health Commission on its official website,it can be found that the legitimacy review mechanism has indeed had a good ef⁃fect,but these documents still have defects in the release procedure,such as the repetition rate of the content of the upper law is high,the coordination between them is not enough,and the accuracy of text use needs to be strength⁃ened.In view of this,we should improve the"standardization"of administrative normative documents from the as⁃pects of"procedural transparency",formulation purpose and allocation of professionals.
