医疗过程中之高风险性和不确定性,使对医疗事故罪之因果关系的认定颇为不易。文章讨论了对群体医疗案件以及医疗过程中之复杂因素案件应如何认定医疗事故罪的因果关系,解析了医疗事故罪因果关系的特点,建议以“一个大前提+相当因果关系学说”的认定路径来认定医疗事故罪的因果关系,重视对医疗损害参与度的审查和运用。

The high risk and uncertainty in medical treatment make it difficult to determine the causality in medical malpractice crime.This paper discusses how to determine the causality in medical malpractice crime in the cases of group medical treatment and the complicated factors in the medical treatment process,analyzes the charac⁃teristics of causality in medical malpractice crime,and suggests that the causality of medical malpractice crime should be determined by"a major premise+equivalent causality theory",and attention should be paid to the exami⁃nation and application of participation in medical injury.
