刑法立法是建设社会主义法治国家不可或缺的一个重要方面。刑法立法如何适应国家治理体系和治理能力现代化的要求,促进良法善治,始终是刑法发展的重大课题。总结过去刑法立法的经验教训,未来刑法立法的价值取向,应当坚持刑法立法的危害性原理,严格控制犯罪圈的扩张;坚持刑法立法的科学化,进一步完善刑法规范体系,构建科学合理的、与犯罪严重程度相适应的刑罚结构体系;坚持刑罚的轻缓化,改造“处十年以上有期徒刑、无期徒刑或者死刑”的立法模式,把死刑的适用对象严格限制在“罪行极其严重”的范围内。

The legislation of criminal law is an indispensable aspect of building a socialist country ruled by law.How to adapt the legislation of criminal law to the requirements of modernization of national governance system and governance capacity and promote good law and good governance is always a major subject of the development of criminal law.Summing up the experience and lessons of criminal law legislation in the past,the value orientation of criminal law legislation in the future should adhere to the harmfulness principle of criminal law legislation and strictly control the expansion of criminal circle,abide by the scientific legislation of criminal law,further improve the criminal code system,build a scientific and reasonable penalty structure system,and adapt to the severity of the crime;It insists on the lightening of penalties,changes the legislative model of“to be sentenced to fixed-term imprisonment of more than 10 years,life imprisonment or death penalty,”and strictly limits the application of the death penalty to those“whose crimes are extremely serious.”
