“双创”背景下高校人事管理的法律风险与防范--以四川大学为例 被引量:3

摘要 事业单位科研人员是“大众创业,万众创新”的重要主体。教育部、科技部和人社部先后出台文件支持和鼓励事业单位专业技术人员创新创业。但“双创”政策也对高校编制管理、岗位管理、聘用管理等各方面的制度实施带来了冲击和影响,高校人事管理面临着岗位管理、薪酬福利、师德师风、社会保障等多方面的挑战。在鼓励高校教师创新创业的大背景下,如何在落实“双创”政策的同时保证高校教育教学工作正常有序运行,是高校管理者们需要慎重考虑的问题。高校应依据国家法规政策,完善管理制度,对于兼职创业人员,经济利益冲突评估备案后,可申请以部分时间和精力参与创办科技企业从事职务科研成果转化工作;对于经批准同意的离岗创业人员,应与学校签订离岗创业合同,合同期内学校按合同约定保留人事关系或工资发放,做到对教职工参与“创新创业”的总体情况进行全面掌握、正确引导。 Scientific researchers of public institutions are the main force of"mass participation in innovative and entrepreneurial activities".The Ministry of Education,the Ministry of Science and Technology,and the Ministry of Human Resources and Social Security have successively issued policies to support and encourage the professionals of public institutions to participate in innovative and entrepreneurial activities.However,those"Innovation&Entrepreneurship"policies have also generated an impact on implementation of HR administration system,post management system,employment management system and other management systems of colleges and universities.The personnel management departments of colleges and universities are challenged by problems related to post management,salary and welfare,teaching morality,social security,etc.Under the background of encouraging teachers in universities and colleges to participate in innovative and entrepreneurial activities,how to guarantee a normal and orderly operation of teaching while implementing the"Innovation&Entrepreneurship"policies is a problem that requires serious consideration of administrators.Colleges and universities should improve their respective management system in accordance with national regulations and policies.For parttime entrepreneurs,they can apply for devoting part of their time and energy to participating in establishment of high-tech companies and transformation of scientific results,provided that interest conflict is evaluated and filed;for entrepreneurs who leave their jobs after approval,a decruitment and entrepreneurship contract should be signed with the school,according to which the school should retain posts or pay salaries before the contract expires,and properly guide the staff to engage into"innovative and entrepreneurial activities".
