警察权作为国家权力体系的重要组成部分,具有执行国家意志的基本属性,在保证国家安全、稳定社会和保护公民生命财产过程中,必然依靠一定的强制力,才能更好地完成职责和使命使用武力是警察权强制性行使的重要方式,警察武力使用是否合法对执法公信力和执法权威都会产生重要影响针对近年来我国警察在武力使用过程中一定程度上存在的规范性不足、程度把握不当、安全防范不强等问题,借鉴美、加等国警察武力使用的标准程序和做法,提出加强我国警察武力使用规范标准建设的必要性和基本途径,为保障警察依法履职,维护警察执法权成,促进我国公安机关执法规范化建设,提供一定的理论参考和借鉴。

Police power is an important part of the state power system,with the basic attributes of implementing the will of the state,ensuring national security,stabilizing society and protecting citizens’lives and property must rely on some coercive force to successfully complete duties and missions.The use of force is an important way of compulsory exercise of police power.Whether the use is legal or not will affect the credibility and authority of law enforcement.In recent years,the use of force by the Chinese police has been problematic in terms of standardization,degree control,and safety precautions.By learning from the standard procedures and practices of police force use in the United States,Canada,and other countries,it proposes the necessity and basic ways to strengthen the establishment of standards for the use of force by police in China.It provides a certain theoretical reference to ensure that the police perform their duties in accordance with the law,maintain the authority of law enforcement,and promote the standardized construction of law enforcement by public security organs.
