论新型举国体制的宪法基础与实施路径

The Constitutional Basis and Implementation Path of the New Whole-Nation System

新型举国体制是推动我国经济社会发展的重要制度法宝。相较于传统举国体制而言,它的"新"表现为集中方式的市场化、力量组成的现代化以及大事范围的可拓展化。新型举国体制具有范围广、力量重的"举国"特征,一旦启动,需要全国上下保持统一思想、统一目标、统一行动。作为一项制度形式,该体制具有稳定性、规范性和实践性的特点。从法学视角来看,新型举国体制的运行有着深厚的宪法基础。其运作根基是社会主义制度,组织保障是中国共产党领导,根本遵循是民主集中制原则,这些内容皆见诸于我国宪法文本。进一步实施该体制,还应结合具体情况,实现放权模式下的央地互动、政府主导下的多元参与以及统筹格局下的利益协调,保障其制度优势不被削减。

New Whole-nation System is one of greatest strengths for China’s economic and social development.Compared with the traditional whole-nation system,there are many new characterizations which are reflected incentralized mode of marketization,the modernization of power composition and the expansibility of the scope of major events.It is characterized by nationwide scope and great strength.Once it is launched,it is required that whole country must achieve unity of ideology,objectives and action.From the perspective of law,it has a profound constitutional basis,and the root is the socialist system,and the organizational guarantee is the leadership of the Communist Party of China,and it should strictly abide by democratic centralism.All these contents can be found in the articles of our Constitution,When this system is under implementation,the central-local interaction with the decentralization model,democratic participation with the leadership of the government and coordination of interests with the overall pattern should be achieved depending on specific circumstances,to ensure the institutional advantages are not reduced.
