大数据视阈下个人信息治理之道

Personal Information Governance Method from the Perspective of Big Data

大数据视阈下,个人信息之存储方式、范畴等较之以往都发生了改变,除人格尊严价值外,个人信息的经济与公共管理等其他价值也愈发凸显。然而,传统个人信息保护的“个人控制”模式已然不能应对大数据时代发展之需求,既无法有效保护个人信息,也阻碍个人信息价值的实现。于此情形下,欧美国家在新近的个人信息保护的立法中呈现出了以平衡个人信息保护与利用为核心的立法旨趣与制度设计,这为我国进行个人信息治理提供了思路。在信息控制者、政府与信息主体等多元主体的参与下,通过行业内部治理、政府外部管理与信息主体自我保护的有机结合,在个人信息的保护与利用之间进行利益平衡,是我国进行个人信息治理的一条有效路径。

In the era of big data,the storage mode and category of personal information have changed compared with the past.In addition to the value of personal dignity,other values such as the economic and public management of personal information have also become more prominent.However,the traditional"personal control"mode of personal information protection is no longer able to satisfy the needs of the development of the era of big data.It can neither effectively protect personal information nor hinder the realization of the value of personal information.In this case,the European and American countries present a legislative purview and system design with the balance between the protection and utilization of personal information as the core in the recent legislation on personal information protection,which provides ideas for China's personal information governance.With the participation of information controllers,governments and information subjects,it is an effective path for personal information governance in China to balance interests between the protection and utilization of personal information through the organic combination of industry internal governance,government external management and self-protection of information subjects.
