信息技术渗透生活各方面,利用制度设计统筹隐私保护与数字经济发展备受社会关注。研究基于消费者隐私数据价值评估和数理均衡分析,发现当平台经营者盈余与消费者边际损失、边际风险不一致时,监管方应积极介入干预,惩罚依据是“消费者福利损伤”。隐私数据的财产属性约定,合规交易机制、维权通道及赔偿机制的建立,是当下维护社会基本公平的工作要点。

With the continuous penetration of information technology into all aspects of life,using system design to coordinate privacy protection and digital economy development has become a social concern.Based on the evaluation of consumer privacy data value and mathematical equilibrium analysis,it is found that when the producer surplus is inconsistent with the consumer marginal loss and marginal risk,the regulators should actively intervene with the punishment criterion of consumer welfare damage.Meanwhile,the property attribute agreement of private data,the establishment of legit transaction mechanism,consumer rights protection channels and compensation transactionsare the key points of the current government work to maintain the basic fairness of society.
