数字经济视域下大数据交易管理法律模型建构研究

Research on the Construction of Big Data Transaction Management Legal Model from the Perspective of Digital Economy

自数据被作为生产要素后,以“大数据”为交易对象的数字经济迅速发展,但数据确权困难、隐私泄露、数字市场秩序混乱、流通机制欠缺、国际数字贸易对接不畅等问题掣肘了数据资源价值的实现。解决该问题需要融合各项法律手段,构筑理想化的大数据交易管理法律模型,对现行法律规范难以规制的大数据交易管理问题,进行跨专业、跨学科的研究,有选择地设计和安排相应的制度,从而为数字经济运行提供规制工具,推进我国数字经济科学化和规范化发展。

Since data was adopted as a factor of production,the digital economy,in which"big data"is the object of trade,has been developing rapidly.However,problems such as difficulties in identifying data rights,privacy leaks,chaotic digital market order,lack of circulation mechanisms,and poor interface with international digital trade have hindered the realization of the value of data resources.To solve this problem,it is necessary to integrate various legal instruments,construct an idealized legal model for the management of big data transactions,conduct interdisciplinary research on the management of big data transactions that are difficult to be regulated by existing legal norms,and selectively design and arrange corresponding systems,so as to provide regulatory tools for the operation of the digital economy and promote the scientific and standardized development of digital economy.
