农地规模经营法律规制的理论阐释与制度重构

正当性证成是规制农地规模经营的正当性基础,农地规模经营法律规制具有正当性。农地规模经营作为实现农业现代化发展的主要途径和重要手段,对其进行法律规制的关键在于构建法律规制理论框架,把控农地规模经营的"度",规避农地规模经营过程中的风险。农地规模经营法律规制具有制度正当性依据,其本质在于抑制政府滥用行政权,规范政府对农地规模经营行政行为的"适度"性。针对当前土地利用效率低下,农地规模经营法律规制制度滞后,农民土地财产权法律制度体系缺位等法律问题,提出发挥市场配置土地资源的功能和决定作用,建立以市场机制为导向的农地规模经营法律规制理论框架,促进农业绿色发展和产业发展,推进乡村振兴战略的实施。

In view of the current land use efficiency is low,the legal regulation system of agricultural land scale operation lags behind,the legal system system of agricultural land property rights is absent and other legal problems,it is suggested that the market should play a decisive role in the allocation of land resources,establish a legal framework for large-scale agricultural land management guided by market mechanism,promote green agricultural development and industrial development,and promote the implementation of rural revitalization strategy.
