生物多样性保护专门立法探析

Research on special legislation for biodiversity conservation

加强生物多样性的保护和可持续利用已成为全人类的共识。自加入联合国《生物多样性公约》以来,我国在生物多样性保护方面取得了长足的进展,生物多样性保护相关法律相继出台,但至今仍缺乏一部专门的《生物多样性保护法》。本文分析了我国生物多样性保护专门立法的现实背景、可行性以及存在的困境,探讨了生物多样性保护专门立法的进路,并提出一系列具体的对策建议。

Strengthening the conservation and sustainable use of biodiversity has become the consensus of all mankind.Since joining the Convention on Biological Diversity(CBD),China has made great progress in the biodiversity conservation.Biodiversity-related laws have been promulgated one after another, but there is still a lack of a special "biodiversity law".This paper analyzes the realistic background, feasibility and difficulties of special legislation for biodiversity conservation in China, discusses the path of special legislation for biodiversity conservation, and puts forward a series of specific suggestions.
