Definition of Property and Function Orientation of Nonprosecution Power of Procuratorial Organs From Perspective of State Governance

推进国家治理现代化一个重要内容就是司法现代化改革。检察机关作为公诉机关在其中占据着诉讼主导地位,基于此其重要职能不起诉权在审判为中心、认罪认罚、捕诉一体等改革中也起着重要作用。由此重新审视不起诉权就变得尤为重要,其性质在保持监督权本质不变的基础上,以程序处分权为依托进行外延扩展,实现实质处断权的突破;其功能在实现宽严相济政策、诉讼经济原则,制衡权力以维护法制统一,保障人权以及实现客观公正义务方面有着多元的体现。

One of the important content in promoting the modernization of state governance is to carry out judicial modernization reform.As public prosecution organs,procuratorial organs predominate,whose important function,the power of nonprosecution,also plays an important role in the reform of trial centered,confession and punishment and integration of arrest and prosecution.Therefore,it becomes particularly important to reexamine the power of nonprosecution.On the one hand,its property,on the basis of keeping the essence of the right of supervision unchanged,extends by relying on the right of procedural disposition to achieve a breakthrough in the right of substantive disposition.On the other hand,its function is diversified in many aspects,such as in realizing the policy of punishment with leniency and the principle of litigant economy,balancing power to safeguard the unification of legal system and protecting human rights and realizing objective and judicial obligation.
