网络空间视域下猥亵儿童罪的法教义学检视

Legal Dogmatics Review of Child Molestation Crime from Perspective of Cyberspace

互联网即时通讯技术的发展,使得网络空间愈发具有现实物理空间的诸多属性,传统罪名体系在网络空间适用时开始呈现出不适应性。近期网络空间性侵儿童案件频发,如何发挥刑法的功能有效规制这类犯罪,学界存在不同认识,司法实务界存在困惑。解决这些问题,需要厘清猥亵儿童罪的保护法益。同时,基于法教义学的检视,需要从立法、司法层面系统地提出对策,这主要有:对网络空间中的性侵儿童行为进行类型化分析,适度扩张本罪的行为类型;明确本罪中"聚众实施"和"在公共场所当众实施"的认定规则,以破除其在司法适用中的难题,也避免本罪适用范围过于限缩。

With the development of Internet instant communication technology,the network space has more and more properties of the real physical space,while the traditional crime system begins to show inadaptability when it is applicable in the network space.Recently,cases of sexual assault against children in cyberspace occurred frequently.There are different understandings in academic circles and confusion in judicial practice circles on how to effectively regulate such crimes with criminal law.It is necessary to clarify the protection interests of child molestation crime.At the same time,based on the review of legal dogma,countermeasures need to be put forward systematically from the legislative and judicial levels,which mainly include classifying and analyzing the behavior with appropriate expansion of the behavior types,and clarifying the identification rules of“organizing a mob to implement”and“Public implementation in public places”so as to get rid of the difficulties in judicial application and avoid the excessively limited scope of application of this crime.
