央行数字货币运行的法律问题研究

央行于2014年开始研究数字货币,目前已在多个城市开始试点工作,央行数字货币的发展,对于提升日常交易效率,保障交易安全,预防金融犯罪有显著作用,对于促进大规模跨境交易,促进人民币国际化,打破美元在世界货币体系中的霸权地位也有重要影响。DC/EP运行体系至少包括发行、兑换、流通、回笼四个环节,由于DC/EP采用数字化加密技术带来的中心化、安全性以及可控匿名性等特征,当下人民币的运行体系不能直接与之有效衔接。需要从法律的角度对DC/EP的运行可能面临的风险进行规制,保证金融的创新发展和金融环境的安全稳定。

The operation system of DC/EP includes at least four links: issuance, exchange, circulation and withdrawal. Due to the centralization, security and controllable anonymity brought by the digital encryption technology of DC/EP, the current operation system of RMB cannot be directly and effectively connected with it. It is necessary to regulate the possible risks in the operation of DC/EP from the perspective of law to ensure the innovation and development of Finance and the security and stability of financial environment.
